Minister of Niger Delta Affairs and All Progressives Congress, APC, senatorial prospect for Akwa Ibom North-West senatorial district seat in the 2019 basic election, Senator Godswill Akpabio, has actually stated he will appeal the tribunal judgement, which dismissed his petition versus Senator Christopher Ekpenyong of Peoples Democratic Celebration, PDP, in the election.

The National Assembly Election Petitions tribunal, Wednesday night, ruled in favour of Ekpenyong of the PDP and dismissed the petition by Akpabio.

Akpabio’s counsel, Adekunle Oyesanya, who revealed dissatisfaction that the bulk choice did not favour him, preserved that after studying the judgement with his customers, he would appeal the choice.

The judgement, which was provided by Chairman of the tribunal, Justice W. Akanbi, with the concurrence of Justice Ebetu, dismissed the petition and promoted the election of Ekpenyong.

In a dissenting judgement, Justice S. Tahir, whose judgment was provided by 11.45 p.m on Wednesday, stated Akpabio and APC had no requirement to present ballot system representatives to show their success considering that they were not challenging what took place at the systems, which the power of cancelling prohibited votes was not in the hands of the returning officer, however in the hands of ballot system officers.

The minority judgement promoted the petition of Akpabio, and revealed the nullification of the success of Ekpenyong as the senator representing Akwa Ibom North-West, Ikot Ekpene senatorial district.

He prompted INEC to recover the certificate of return from Ekpenyong and surrender it to Akpabio as the chosen Senator of the district.

However in the bulk judgment checked out by the chairman of the panel, Justice W. Akanbi, the tribunal preserved that the petitioners stopped working to bring any witness from the ballot systems and hence might not show considerable non-compliance with the Electoral Act.
